After a judge dropped the criminal homicide charge against an Erie man, prosecutors are asking the judge to re-file the charges.

51 year old Jeffery Selby was charged with criminal homicide after Erie police accused him of killing his girlfriend. 51 year old Mary Ann smith in her west side apartment.

District Attorney Brian Krowicki tells us the prosecution had filed a motion last week to get Selby's trial reinstated. They should be hearing back from the judge as early as next week to see if the trial will be re-filed.

Selby is charged with unlawful restraint, aggravated assault, and recklessly endangering another person, as of now, those charges will be bound over to trial.

Judge Tom Carney dismissed the criminal homicide charge against Selby because the Erie County Coroner ruled the cause of death to be undetermined.
