An Erie man accused in the shooting death of 32-year old Joshua Dibello last July will spend at least the next 22 to 45 years behind bars. David Patrick McHenry entered a plea agreement Wednesday morning in Erie County court. McHenry pled guilty in front of the victims family as well as his own family to third degree murder. He will spend the next 22 to 45 years in prison. When Dibellos sister spoke on behalf of her family, McHenry sat in the corner of the courtroom sobbing as he heard her words. She said the family feels angry, sad, depressed and incomplete. During the near hour and a half proceeding, McHenry addressed the victims family stating he is truly sorry and will always regret taking the life of a son, a brother, and an uncle. Judge Cunningham
