A man accused of shooting and killing an Erie visitor in 2005 will stand trial for criminal homicide.

Richard Patton is accused of fatally shooting 53-year old Steve Lynton of New Jersey.

Patton was in an Erie County courtroom Thursday morning for a preliminary hearing. It was a very emotional day for both the victim and defendant's family's.

Charges of murder, aggravated assault, reckless endangerment and possessing an instrument of crime were bound over to trial.

In September of 2005, then 53-year old Patton held police at bay for more than four hours at West 26th and Melrose, after he allegedly shot to death Steve Lynton in the alley between two homes.

Thursday, both the victims family and the defendants family listened as testimony was given by several eyewitnesses in front of Judge Dominick Dipaolo.

The defendant, Richard Patton suffers from mental disorders.
