Legal Battle Continues

Legal DelayThere's yet another delay in the legal battle over whether a death-row inmate should be put to death for murdering an Erie woman.

38-year old Jose Marrero was convicted of first degree murder for strangling a 68-year old woman in 1994.

Marrero's death sentence has been put on hold for years over the question of whether he is mentally retarded.

If Marerro is found to be mentally challenged, he would no longer face capital punishment.
A new hearing could take place in either August or September.
