Federal Judge Grants City of Erie's Request For New Firefighter Trial
A Federal Judge has granted the City
of Erie's request for a new trial in a
lawsuit that reinstated an Erie firefighter.
Back in February, a jury found the
city in violation of the Americans with Disabilities Act when they fired Mary Wolski
after she intentionally set a fire back in 2007.
Wolski claimed the reason was because
of severe depression, however the city said the termination was because she was
unfit to be a firefighter.
Since the trial, the city has had
the burden to prove the court was wrong.
On Friday, Federal Judge Sean McLaughlin
made his ruling to grant the request for a new trial.
An attorney for the City of Erie said the ruling was made in their favor because on an error in instruction given to the jury previous to their deliberations to find if the city should be held liable.
