Rachel Kozloff Convicted of Third Degree Murder

December 7, 2012 - The  Rachel Kozloff murder trial went to the jury this morning and shortly after 3pm, rendered a verdict of guilty on charges of third degree murder in the death of 31 year old Michael Henry.
She was also found guilty of one count of possessing instruments of crime and endangering another person.
Kozloff will be sentenced on January 29th.

 
Rachel Kozloff took the stand Wednesday morning to describe every that happened on the night of her boyfriend Michael Henry's murder.
She confessed to shooting him because she thought he was going to kill her. In over a two hour long testimony, Rachel Kozloff began to tell the jury exactly what happened on the night of April 12th.
She tells the jury of eight women and four men that it all started back on Valentine's Day when 30 year Kozloff met her 31 year old boyfriend Michael Henry.
She explains "the first few weeks were great, it was ideal, but I had no idea he was part of a motorcycle club or selling drugs."


She says Henry took steroids on a daily basis and had numerous outbursts during the course of their rocky eight week relationship.
Kozloff talks about the fights that Henry would get into every time they went out.
She explains when he saw people from other motorcycle clubs he didn't get along with he started brutally beating them up.


Kozloff tells the jury "his weapon of choice was his fist."
She explains after one frightening argument the couple had had after Henry had gotten into a fight at a bar where there were gunshots involved... Kozloff just wanted to go home because she was upset.
She explains he didn't take no very well, especially when he wanted sex.
At this point of the testimony, Kozloff begins crying, telling the jury "that was the first time he raped me - he held my ankles down and I couldn't walk for three days."
Kozloff also talks about how her boyfriend was controlling and would send her threatening texts
One text read "no one gives me orders and i could train you how i want you."
Kozloff states Henry told her he had gone to jail for assault for five years. She explains he knocked someone out so hard they went into a coma.
Kozloff said they also had conversations about her kids and Henry would tell her "I can't have black step kids because it's not right."
But she continues, saying she didn't end the relationship because she was growing attached to his son Jackson.


On the night of April 12th, Kozloff explains the day started off fine... after work she had gone to his apartment where he tried to force her to give him oral sex.
She refused because she "smelled sex on him."
She said she was angry with him that day and wanted to end their relationship.
Later that night, Kozloff explains Henry went to the restroom, when he came out he was livid and started screaming at her to leave.
She tells the jury he threw her down the stairs just to walk back down and drag her back up.
Kozloff says Henry told her "I'm going to teach you a lesson you'll never forget."
Kozloff begins crying again telling the jury that he began abusing her and throwing her around, she was scared for her life and grabbed her gun and fired shots.
As Kozloff cries she explains "I can't believe I shot Mike, but I didn't think I would make it out alive."
After that she ran out of his apartment in panic.
Kozloff says she only thought she shot Mike once in the arm and was afraid he was after her but she didn't think she had killed him.
Kozloff said on her way home she threw her gun out the window in Millcreek but again, didn't think she killed him.

IF she didn't know he took steroids and then found out that he took them & was in a gang AND violent, she COULD have walked away...And if she KNEW he was doing illegle things, she could have reported him...but I think she LIKED being with him and with the gang, and I do believe that if he threw her down the stairs, and then again did it, she'd have many broken bones or major bruises, wouldn't she?
