Defense Seeks Reason For No Death Penalty For James Duncan

The defense in the case of 31 year old James Duncan believes they found a new reason to drop the death penalty...

Back in June of 2011... 27 year old Nikkia Sawyer was found bound, gagged, and stabbed 50 times in the chest and the face in her bedroom at highpoint towers...

    31 year old James Duncan was arrested for the murder...

    DA Jack Daneri tells us the brutality of the crime led them to seek the death penalty...

    But the Defense, Jamie Mead has found IQ scores for Duncan... Saying that his low scores would block Daneri from seeking the death penalty under the eighth amendment... That in part explains the death penalty can't be forced upon someone who doesn't have the ability to learn right from wrong.

This happens all over the country all the time. Anyone tested under an IQ of 80 can't be sentenced to death and most of the time not even incarcerated. He'll end up in a mental institution for the rest of his life at the cost of the taxpayers. All because he did poorly on a test. Isn't that fantastic... Muder someone as brutally as this P.O.S. did and all you have to do is play stupid to get off. I hope his defense and him rot in hell together.
