Ken Barnes in Court

 Ken Barnes says he's not guilty of the crimes against him. He's one of the two people indicted in the bizarre 2003 pizza bomber case. He made his first appearance in federal court this morning.

Ken Barnes stood before federal judge Susan Paradise Baxter earlier around 10:30 Thursday morning he told reporters on the way to the courtroom...He's innocent.

Kenneth Barnes was indicted on three charges including conspiracy to commit bank robbery, armed bank robbery and carrying a destructive device relating to a crime of violence. Barnes waived his right to a detention hearing in federal court and pled not guilty to all of the charges against him.

Alison Scarpitti, Defense Attorney: "This was the first day he got to look at the indictment so we did go through that with him and at the point we expect to get the most of the discovery with in the next week or so after that we'll have a much better understanding or what we need to do."

We asked Barnes' privately retained lawyer if he expected these charges.

Alison Scarpitti, Defense Attorney: "There have been rumors going around for months that he would be indited...So it wasn't a huge suprise to him but he is concerned and is maintaining he has no culpability in this what so ever."
    
This trial has now been assigned to federal judge Sean McLaughlin. We also learned what will happen in coming days.
 
Alison Scarpitti, Defense Attorney: "What were probably going to have to is file a motion to extend the time for us to file our pre-trial motion so we can get the discovery and go through everything."
   
If Barnes is convicted he could face life in prison and fines of 750-thousand dollars.

Alison Scarpitti, Defense Attorney: "He truly believes he wasn't involved the way the FBI says he was involved....I think that's accurate."
   
Meanwhile, Marjorie Diehl Armstrong who will be in federal court Friday is also maintaining her innocence in this case.
