Erie County Judge Says Statements Alleged Killer Made Can Be Used In Court

October 2, 2012--An Erie Judge denies an accused killer's attorneys request to throw out statements she made to authorities following the shooting death of her then boyfriend.

Rachel Kozloff is accused of shooting 31 year old Michael Henry to death at his East 18th Street apartment back on April 12th.

Kozloff's attorney, Jamie Mead asked Judge Shad Connelly to suppress statements she made to officers following the incident.

Mead claims at the time she was not told she was under arrest and only agreed to talk to them because she didn't think she was being charged.

Jury selection is scheduled to get underway later this year.
