Erie judge denied a motion proposed by the defense in the Nikkia Sawyer case.

Back in June of 2011... Nikkia Sawyer's mother found her 27 year old daughter bound, gagged, and stabbed 50 times in the chest and the face in her bedroom at highpoint towers...

31 year old James Duncan was arrested for the murder...

District Attorney Jack Daneri tells us the brutality of the crime led them to seek the death penalty...

But the Defense Attorney, Jamie Mead tells us evidence is missing, and could possibly point to a different suspect...that's why mead filed a motion yesterday to have those charges dismissed...

But this morning, the judge denied mead's motion, that Daneri had previously opposed...Mead tells us he filed a motion to continue the case, which will be postponed from its original February date.
