Homicide Charge Dismissed Against Selby

January 24, 2013- A charge of homicide has been dismissed against an Erie man arrested for the death of his girlfriend last November.

District Judge Tom Carney dismissed a homicide charge against 51 year old Jeffrey Selby in the death of Mary Smith.

Erie police accused Selby of inflicting fatal injuries on Smith in her apartment at 428 West 17th Street last November 24th .

Selby was charged with attempted homicide in the incident but that  charge was withdrawn, and a homicide charge was filed against him after Smith died at St Vincent Health Center three days later.

Erie County Coroner Lyell Cook ruled the cause of Smith's death "undetermined".

Carney ordered Selby held for trial on the lesser charges of aggravated assault, recklessly endangering and unlawful restraint.

So the coroner hasn't got a clue. Way to go Cook. What did this woman die from? Was it her 3 day stay at St. V? This is a major failure for justice.
