Autopsy Identifies Man Shot And Killed After Trying To Rob Beer Store

A man attempted to rob a Beer For Less store in Millcreek is identified

Coroner Lyell Cook tells us Patrick Atkins, 21 years old, was pronounced dead at Hamot yesterday just before 9 pm. Cook says he died of a single gun shot wound to the chest, and Cook ruled it a homicide.

 

The shooting happened just after 8 tonight at the Presque Isle Beer For Less store at 2756 West 12th Street.

 

Atkins reportedly walked into the store with a small handgun in an apparent attempt to rob the store.

 

The clerk in the store was armed with a handgun and shot the suspect three times.

 

Atkins stumbled from the store and collapsed a short distance away.

@Robert From what has been reported it appears the clerk did have the right to open fire. The clerk is an employee who had a legal right to be where he was. The robber came into the store and pointed a weapon at the clerk, which immediately allows the clerk to respond with deadly force due to self defense. It has been ruled a homicide, but my guess it will be a justifiable homicide under self defense. The only thing that could change that is if store cameras or something show that the robber did not point his weapon at the clerk. In that case the district attorney would be fully justified in bringing charges because you cannot simply shoot someone because they have a gun. The person has to be threatening you with the gun, IE pointing it at you.

I hate to see a young life gone, BUT, its about time these business's start showing these thieves they aren't going to get away with stealing from everyone. When they show a gun or say they have a gun, they deserve what they get. Simple as that!

A life was SAVED HERE (and possibly many more)! This is a perfect example of when a gun was used properly. I would bet this story never gets cited as an example of how a gun could save a life or how this incident removed a criminal and a gun from the street.

The robber ABSOLUTELY got what he deserved! When an individual is threatening with lethal force, they are putting their own life at risk! Get your head out of your [censored] ROBERT M! It is people like you (and your way of thinking) behind the problems with society and the criminal justice system. Have you NO COMMON SENSE??? Do you believe the criminal is a victim?? Did the clerk have a right to open fire? The robber didn't deserve a death sentence but if force was necessary it was unavoidable. The shooting needs to be thoroughly investigated.
