FEBRUARY 3, 2013- Police were called to the bus stop at 9th and State Streets around ten Sunday morning where 44-year-old Marvin Butler's frozen body was discovered.

According to Deputy Coroner Dennis Suscheck, security cameras captured Butler in the bus stop around 5:30 a.m. showing movement.

Just after 10 he was found unresponsive.

When Butler was discovered he was wearing a light spring coat.

Deputy Coroner Suscheck tells us the official cause of death won't be released until toxicology results come back in three weeks.

But he says Butler had hypothermia and the freezing temperatures may have contributed to his death.

Several people who frequent MHA claim they saw Butler at the facility the night he died. However, Mental Health Association officials say they have no record of Marvin Butler being at MHA just prior to his death.
MHA has a policy where if you come into the facility under the influence you must leave, but you can still wait in the foyer of the building.
Since we started following this story, there have been conflicting reports about the status of Butler and where he lives.
Action News has confirmed Marvin Butler was a tenant at the Lodge on Sass. Records indicate Butler resided at the transitional housing apartment for nearly a year.
Tina Butler says her brother was a family man who was active at his church.
She admits he has battled mental illness and alcohol abuse in the past, so it's possible he may have relpased and become disoriented. She thinks Marvin Butler may have stopped to rest at the bus stop because he uses a cane and has trouble walking long distances. The family believes he fell asleep and became a victim of hypothermia.

Toxicology results of Butler's official cause of death will be released in three weeks.

Oh, how sad!! How terrible to tell someone that they cannot stay to get warm with our freezing temperatures! Even tho Mr. Butler had been drinking, someone SHOULD have gone a little out of their way to help him to the foyer!! Just because some goes to a warming shelter, doesn't mean that they are totally homeless, at least he was making a stop to get warm before he would have gone on, maybe, he just KNEW he couldn't make it all the way home! The MHAWarming Center SHOULD have done a bit more! Aren't they there to CARE in the first place? And now, a man has died...SHAME on you at, MHAWarming Center...a little "extra" would have saved Mr. Butler!!

Mr. Butler was not homeless. He had an apartment. His family was very involved in his life.

How heartbreaking that this sad and lonely human couldn't get the help or love he needed from either society or family here in Erie. At least his suffering is over and his agony has ended. How can anyone bear to see those homeless in the nightmare winters here in NWPA?
