Defense In James Duncan Case: Evidence Is Spoiled

31 year old James Duncan was arrested for the murder of 27 year old Nikkia Sawyer.. Whose body was found bound gagged and stabbed 50 times in her Highpoint Towers apartment back in June of 2011

Defense attorney Jamie Mead says, there's an issue over surveillance video needed for evidence in this case.

Mead says the highpoint towers tapes were rerecorded over and he's arguing that the defense is handicapped and the evidence is spoiled because they can't watch the video that's relevant during the period sawyer was murdered.

Mead says this is a capital murder case, and Duncan faces the death penalty, so they need all of the evidence they can get.

Judge Daniel Brabender will be issuing an order over the next few days.. In hopes of possibly recovering the video needed for evidence on the defenses side.
